中国特色社会主义法治体系视野下的人民陪审员制度

摘要

As a fundamental part, people assessor system is greatly significant to the comprehensive promo-tion of rule of law and the development of socialist judicial system in China.The existing defects and realistic diffi-culties of this system can be summarized as formalism on system, operation, and concept.Therefore, future reform efforts should be made to change the operation mode from so-called“unseparated power” into“separated power”. Consequently, the people assessor system can be enhanced and truly embody civic rights.%人民陪审员制度是我国一项基本司法制度，是我国全面推进依法治国、建设中国特色社会主义法治体系的进程中的重要一环。人民陪审员制度当前存在的制度缺陷和现实困境可以总结为制度、操作和观念三个层面的形式主义。将现行的共职共权模式改为分职分权模式、遴选机制，并回归大众化路线，才能体现人民陪审员制度的公民权利属性，有可能改变人民陪审员制度存在的一些不足和不力状况。
