国际劳工标准在中国的适用及启示——基于中国“民工荒”的现状分析

         

摘要

In the mid-1990s,some countries attempted to link labour standards with international trade,then accused other countries of violating labour standards in international trade and affecting international trade balance.As one of the main exexporting countries of labour intensive products,China is inevitably accused.At the very beginning of 2011,labour shortage became a common phenomenon in China.Many companies improve welfare level to recruit new employees.Yet the gap in labour standards between China and developed countries is still obvious.The government should adjust legislation standard,strenghten enforcement,supervision and popularization of laws,and set up reporting system of corporate responsibility.Enterprises should change the development mode,attach importance to training for talents,strengthen innovation ability and actively participate in the activities of strengthening corporate responsibility in labour standards.%20世纪90年代,部分国家企图将劳工标准和国际贸易挂钩,以此来指责他国在国际贸易中违反劳工标准规定,影响国际贸易差额。中国作为劳动密集型产品的主要出口国难免被指责。2011年伊始,中国出现大规模的"民工荒",各大企业为招聘员工纷纷提高劳工待遇;但中国劳工标准和发达国家相比仍有差距。从政府层面应该完善我国劳动立法,提高立法标准,加强执法、监管和普法力度,并建立公司责任报告制度;企业层面应该改变发展模式,重视人才培养,增强创新能力以及积极参与有关劳工标准的强化责任活动。
