浅析俄罗斯破产重整中调查制度对债权人利益的保护

摘要

2002年俄罗斯破产法完整地规定了＂企业挽救制度＂,即重整制度（реорганизация）。在破产重整中对债权人利益的保护制度做了具体的规定。其中调查制度（наблюдение）设置集中体现了对债权人利益保护的理念,对债权人保护具有重要作用。%The Corporate Rescue System,or Reorganization system（реорганизация）,was stipulated in full detail by The Bankruptcy Act of Russia in 2002,in which the protection system for the creditor＇s interest is specified.The setup of investigation system（наблюдение） epitomizes the perception of ensuring the interest of creditor.This paper introduces this unique system in Russia＇s bankruptcy law from the perspective of specific institutional design and analyzes its significant role in protecting creditors as well.
