2012年新通过的《刑事诉讼法》中关于＂未成年人暂缓起诉＂的规定标志着我国未成年人司法转处制度的正式建立。我国未成年人司法转处制度刚具雏形,设计机理不明确,内容上过于狭隘,具体操作上主体、程序、标准模糊,与司法转处制度相配套的制度不成熟,进一步研究这些问题有现实的必要。%The stipulation of ＂deferred prosecution of juveniles＂ in The Amendment to the Criminal Procedural Law adopted in 2012 marks the formal establishment of juvenile diversion system in our country. The system is just in the embryonic form. The design mechanism for the system is not clear. The content is too narrow. In the actual operation, the subject, the procedure and the standard are not distinct. Related corresponding systems are not mature. It is actually necessary for us to make further research into all these problems.
