从反腐败制度建设视角看韩国的行政复议制度

摘要

The root causes of corruption lie in the defects of the system. Therefore, fighting corruption should focus on the system construction, which involves the whole system of fighting corruption. Administrative review is an important part of the system of fighting corruption. From the perspective of developing the fighting-corruption system, this paper makes a brief description of the process of developing Korean administrative review and reveals the set of key elements that marked the maturity of Korean administrative review, such as, the idea, legal status, independence, impartiality, objectiveness and authoritativeness. The qualified professional's participation in the administrative review is a major innovation of Korean administrative review. In a word, the fledged Korean administrative review is of significance for improving the fighting-corruption system of other administrative agencies.%行政复议制度是反腐败制度建设的重要一环。以反腐败制度建设为视角，通过对韩国的行政复议从很不完善到成熟的制度建设过程的扼要描述，揭示了理念、法律地位、独立、公正、客观和权威性是构成韩国行政复议制度走向成熟的一组关键要素，有资质的民间人士参加行政复议机构是韩国行政复议制度的一大创新，进而揭示了韩国成熟的行政复议制度对其他行政机关反腐败制度建设的推动作用。
