版权保护技术措施的危害及其规制

摘要

Unlimited copyright technological protection measures may induce great harms including paracopyright, violation of human rights and obstruction of creativity. The conflicts of interests between copyright owners and users are actually reconcilable. The existing law does not accord with the international treaties and provides overprotection for technological measures. In order to rectify the current unjust situation, during the third amendment of the Chinese copyright law, a private use limitation on the information network transmission right should be admitted, and the circumvention of technological measures in the case of private use should be allowed. Besides, a restrictive reading of“effectiveness”in anticircumvention rules should be adopted as a balanc tool to adjust the scope of copyright protection.%无限制的版权保护技术措施存在着超越版权、侵犯人权和损害创作三大危害。实际上，版权人与使用者之间的利益冲突是可以协调的。针对我国现行法不符合国际条约规定、存在过度保护技术措施的现状，《著作权法》第三次修改应当对技术措施进行合理规制，从保护使用者利益的角度增加对信息网络传播权的个人使用限制，并允许基于个人使用目的规避技术措施。此外，应通过狭义解释技术措施的“有效性”来调节版权保护的范围，重塑版权人与使用者之间的利益平衡。
