农村转移人口市民化的法律保障机制构建

摘要

随着城镇化进程的加快，农村人口将更大规模地向城市转移和集聚，其工作、居住、子女的繁衍和教育等将逐渐完全在城市进行，市民化也必将成为一种趋势。拥有与市民相一致的身份资格与权利资格，是农村转移人口在市民化过程中理当享有的应然权利，完整市民权的拥有将建立在均衡资源配置、创新政策制度的基础之上，通过立法、执法、司法三位一体的共同作用，实现农村转移人口应然、法定、现实权利的递进转换。%With the acceleration of China’s urbanization,more and more rural population will move to city and gather there,and then work,live,multiply their children and give them education.At this background,Urbanization will become a trend.Owning the qualification of identity and rights which are consistent with the citizen is an obligatory rights of the rural-urban migration when they change to be citizen,but the realization of the obligatory right relies on the balanced allocation of resource and innovated policy,the conversion of obligatory right to legal right,and the legal right to actual right will be realized by legislation,law enforcement,and judicial which performance together.
