建筑施工合同中赠与条款的法律性质及管理对策

摘要

First,the paper clarifies the concept of bribery,discount and donation,clears the boundaries of them. Then,from the point of offer,the validity of the contract,donation and gifts,donation items,discusses the legal nature and status of the donation clause. From the legal nature of construction contract donation terms,clears the instruction execution and perform quality. At last,according to the construction projects in China,gives the actual corresponding policy and institutional recommendations.%厘清贿赂、折扣及赠与的概念，明晰相互之间的界限；从要约角度、合同效力角度、捐赠与赠与区分角度及赠与条款角度深入分析赠与条款的法律性质和地位；从建筑施工合同中的赠与条款的法律性质入手，明确赠与条款的履行指令和履行质量。最后结合我国建筑工程项目的实际，提出相应的政策和制度建议。
