The defect of heart death standard led to the appearance of brain death standard. Transition of death standard forced people to recognize what is death again. Based on these, the paper describes the scientific status of brain death and its legislation, and it analyzes the ethical and legal issues caused by brain death standard. The paper discusses and demonstrates the significance of brain death from the perspectives of progressing thoughts, development of the law and medical science.
