论职务发明纠纷解决机制--兼评《职务发明条例草案(送审稿)》

         

摘要

实践中,职务发明人的署名权被侵犯、职务发明人无奖无酬、有奖无酬、企业职务发明制度不规范等情况屡见不鲜。职务发明纠纷多发于权属和奖酬,纠纷多与劳动用工有关,发明人权益难以保障。国家知识产权局公布的《职务发明条例草案》中有关于监督检查与法律责任的规定,行政执法的主动性让权利人比较快捷方便地维护自己的权益,同时公权力在阳光下行使也不会加重企业知识产权管理的负担。建议修改条例中的个别条款,列明对具体行政行为的救济途径,增加行政调解协议司法确认的规定,力求在保护职务发明合法权益的基础上,在职务发明人的权益和单位的权益之间取得平衡。%In practice, it is not infrequent that signature right of service inventor being infringed, service inventor without prize or remuneration, IPR management system of enterprises being not regulated. Service invention disputes often occurred from proprietorship,prize and remuneration,closely with labor employment. Draft Regulations on Service Invention issued by State Intellectual Property Office has some provisions about supervision, inspection and liability. Administrative enforcement is beneficial for right holders to safeguard themselves and wouldn’t burden enterprises with sunshine enforcement. The paper suggests modifying some articles to get the balance between service inventor and enterprise.
