维护中国在南海地区的国家利益——正名、服务、领导、划界

摘要

There are some key words on the issue of the South China Sea (SCS),which are "sovereignty over islands and rocks","U-shaped line","semienclosed sea","services and leadership" and "maritime delimitation".We may view China's major issues of interests in the SCS from the prism of above terminology.Specifically,it can be discussed in the following aspects:firstly,due regard should be paid to the legal attribute and rectification of the names of the U-shaped line;secondly,it should be noted how to take actions and provide services in the SCS;the last but not the least,the delimitation of the SCS especially the Nansha waters.This paper intends to offer some views and suggestions on the three aspects.%讨论南海的问题有几个关键词:“岛礁主权”、“U形线”、“半闭海”、“服务与领导”,以及最终的“海域划界”.我们看待维护国家在南海地区重大核心利益的问题,也可以从这几个角度来考虑.其中,归结到最后的具体问题,可以分述下列几个部分:首先,应该正视南海U形线的法律定性与正名问题;其次,必须考虑如何在南海社区采取行动、提供服务;最终,仍然要面对南海地区,特别是南沙海域的划界问题.本文所提供的正是有关这三个方向的一些见解与建议.这些内容也是我们研究的部分心得,提出来以供各界学者专家参考、指正.
