国家治理视域下的中国环境法治困境

摘要

环境法治困境是国家治理失灵在环境治理领域的体现，而环境治理领域的国家治理失灵可能意味着全面的执政风险。本文通过探究环境立法、环境行政和环境公益诉讼过程中以立法腐败、行政官僚化和司法行政化为主要特征的环境法治困境，寻求提升环境领域国家治理能力的中国进路。%China's environmental governance over the last 30 years is a failure in terms of the effect.The dilemma of environ-mental protection is the embodiment of the failure of national governance in the field of environmental governance,which means a comprehensive ruling risk.In this paper,the main features of the dilemma of environmental protection are explored,including corruption in environmental legislation,bureaucracy in environmental administrative and bureaucratization in environmental pub-lic interest litigation process,so as to find out a Chinese approach to enhancing the environmental governance capacity.
