An examination of rule change: The evolution of trade remedy laws in North America.

摘要

The dissertation employs new-institutionalist theories to explain the changes that occurred in the North American trade regulatory process after 1989. The thesis proposes that changes occurred to the characters of the three domestic trade remedy regimes within the context of Chapters 19 of the Free Trade Agreement (FTA) and the North American Free Trade Agreement (NAFTA). Changes in the characters of the three regimes were caused by the degree to which socio-economic factors were reduced by Chapters 19 binational panels. Changes in the characters of the three regimes will be measured in terms of the fairness, transparency, and speed of the process of judicial review.
