《永不消逝的墨迹：曾格案与美国新闻自由的诞生》第九章汉译项目报告

摘要

在不同的地方，法律以不同的方式阐述公民的权利与义务。因此，法律专著翻译具有学术和实践双重价值。笔者有幸参加了东方出版社《永不消逝的墨迹:曾格案与美国新闻自由的诞生》(Indelible Ink:The Trials of John Peter Zenger and the Birth of America'sFree Press)一书的汉译项目。目前，国内图书市场尚无详述曾格案始终的同类译著出版，本项目是对该书的首译，为学界对曾格案开展深入研究打下了坚实的基础。
　　笔者以第九章为案例撰写了该项目报告。本章记述了曾格案庭审的辩论过程，其文本体现出法律学术语言的专业性与严谨性。从阐释学出发，笔者深入分析了英汉在词汇，句读和语篇层面的差异性与可译性，明确了专有名词及术语、修辞语言、语篇衔接等翻译重点与难点。与之相应，笔者强调了上下文，语用意义及言内意义在翻译过程中的重要性，由此阐发了不同的翻译策略，以期能够对日后的法律学术翻译起到一定的指导作用和借鉴意义。
