Place of Exceeded Intention in the Structure of Guilt

摘要

The author, analyzing the forms of guilt mentioned in the New Criminal Code reveals differences in terms of how it is treated in the new penal code the exceeded intention in relation to the criminal code in force. Further, the author wonders if the solution of the new criminal code is more justified than that adopted by the criminal law in force.
