The authors analyze the crime committed by omission of the Criminal Code in force highlighting its distinctive features and its importance. The new Criminal Code recently adopted by the Government accountability [1] provides for the first time in art. 17 the solution of committing the offense of commission by omission in the provisions of the Criminal Code. In this way, the new Criminal Code (in force since February 1st 2014) is distinguished from the previous criminal codes that did not contain such a regulation.
