The Legal Nature of Farmland for Water Supply and Drainage Underground Pipeline Passage

摘要

The purpose of this paper is to answer the real dilemma and the theoretical relative blank on the legal nature of farmland for water supply and drainage underground pipeline passage in China. Methods of comparison, legal norms analysis were employed. The research showed the farmland for underground pipeline passage was the main way in the construction of water supply and drainage underground pipeline. The farmland for underground pipeline passage had characteristics of limited and partial use, long-term use and restricted use, which accorded with the essence and legal condition of rural servitude. It is conduciving to realize a win-win situation among all parties, and to maintain the order of farmland use after setting the passage right of the water supply and drainage underground pipeline for rural servitude.
