Along with Chinese governments' reform unceasingly,performance management has attracted all levels of government departments' concern. However,the governments' performance management and appraisal have not obtained the integrity stipulation clearly on the legislation. The governments' performance management and appraisal lack special protection by law. The mechanisms of monitoring and post-relief system are not perfect. This paper uses methods of comparison,analysis and innovation to resolve the problems of Chinese governments' performance management and appraisal legalization. Firstly,it compares Chinese governments' performance management and appraisal legalization with that of the Western developed countries. Secondly,it tries to analyze the condition of Chinese governments' performance management and appraisal legalization on many aspects. Thirdly,it proposes some effective countermeasures of Chinese governments' performance management and appraisal legalization. In all,to improve Chinese governments' performance management and appraisal legalization,it must find a way to develop fairly rapidly with Chinese characteristics.
